According to the Massachusetts Food Association, any operator who sells any bakery product in units of five or fewer (for example: two bagels, two muffins and one Danish), are subject to the Massachusetts sales tax on meals. Operators are only exempt from the sales tax when baked goods are sold in units of six or more.
